HARRISBURG, Pa. (AP) — The judge overseeing the child sex abuse case against former Penn State assistant football coach Jerry Sandusky issued a gag order Monday that severely limits what attorneys on both sides may say to reporters.

Judge John Cleland's order also applies to any law enforcement investigator who has worked on the case and anyone acting on behalf of the lawyers.

The off-limit topics include evidence; opinions about Sandusky's guilt or innocence or about the merits of legal and factual matters under discussion; and "the reputation, character, credibility or criminal record of the defendant or any witness, prospective witness or organization which is or may testify at trial, or be the subject of trial testimony or evidence."

He directed the lawyers to "make reasonable efforts" to limit statements by witnesses or the witnesses' lawyers and to be able to prove they have taken those steps.

Cleland said he was acting to help ensure a "fair, impartial and orderly trial" for Sandusky, a proceeding scheduled to begin June 5 in Bellefonte.

Sandusky, 68, is charged with sexually abusing 10 boys over 15 years, and authorities say some of the abuse happened on Penn State's campus. Sandusky has maintained his innocence on the 52 counts against him.

The ensuing scandal led to the firing of legendary football coach Joe Paterno and the ouster of the university president.

Sandusky attorney Karl Rominger said he was studying the order.

"Having never been gagged by a court before, I will need to research the law and First Amendment issues," Rominger said in an email. "I'm pretty sure the court has the authority to limit press contacts, I just don't know what the law says about the scope and nature of such limits. Since the order does affect the media as well, I'll be curious to see if any press outlets appeal it."

A spokesman for the attorney general's office declined to comment.

Cleland said his order applies to comments that could reasonably be expected to be disseminated and to comments made on background or without attribution.

Lawyers on both sides have been speaking to banks of cameras and reporters after pretrial hearings at the Centre County Courthouse, a practice that is certain to be limited, if not ended outright, by the judge's order.

After a brief hearing on April 5, prosecutor Joe McGettigan was critical of the defense's tactics and responded to a defense claim that the charges lack specificity by telling reporters that Sandusky had been "provided with voluminous documentation of perversions against young children."

Cleland's order wasn't accompanied by any decisions regarding the defense motions that were the topic of last week's hearing, but the judge previously said he would decide on them this week.

Cleland wrote that the order was "narrowly tailored to achieve its purposes in light of the unprecedented publicity generated by the case" and that he will "broadly construe this order to assure that its purposes are achieved."

He also warned lawyers to comply with professional conduct rules regarding pretrial publicity, the special responsibilities of prosecutors and the state court system's code of civility.

Also awaiting trial are Gary Schultz and Tim Curley, Penn State administrators accused of lying to the grand jury investigating Sandusky and failing to properly report suspected child abuse. A Dauphin County judge on April 5 issued an order that set deadlines for various defense and prosecution filings, including catch-all defense motions by July 30, as well as a June 1 status conference on the case at a Harrisburg courthouse.

Curley, the school's athletic director, is on leave. Schultz, the former vice president for business and finance, has retired. Both have repeatedly denied the allegations.

Tampa personal injury attorney Lawrence Disparti warned Florida drivers today that recently passed changes in state PIP law make it important for the injured to act quickly to protect their rights to insurance payments.

Florida’s personal injury protection insurance law, or PIP, now puts the burden on the injured individual to qualify for compensation to pay for medical expenses and other losses due to their injuries, said Disparti, founder of the Disparti Law Group.

“Some are calling the new law a boon to insurance companies, and we tend to agree,” said Disparti, founder of the Disparti Law Group.

The law firm serves accident and injury victims throughout the Tampa-St. Petersburg-Clearwater metropolitan area, including victims of motor vehicle accidents.

“What’s important now is that people hurt in car accidents take the steps they need so they will not miss out on the financial assistance they are entitled to receive.”
House Bill 119 is an amendment to the PIP law adopted in 1972 to ensure that anyone injured in a Florida auto accident would quickly get money to treat their injuries.

The bill, which was adopted during the recently completed legislative session, requires injured people to obtain medical care within 14 day of their injury. The care must be from a physician, osteopath, dentist, chiropractor, physician’s assistant or advanced registered nurse practitioner, or from a hospital or in a facility wholly owned by a hospital.

Also, a physician, osteopathic physician, dentist, supervised physician’s assistant or advanced registered nurse practitioner must determine that the individual has had an “emergency medical condition” for them to qualify for the full $10,000 medical benefit defined in the PIP law since its inception.

Without declaration of an emergency medical condition, the insurance payment is capped at $2,500.

Legislators say the law’s changes will reduce insurance fraud. Others disagree.

“Floridians are in for a rude awakening,” Florida Consumer Action Network spokesman Bill Newton said in the Insurance Journal. “Instead of measures aimed at preventing true fraud, we’re left with a bill that pads the pockets of big insurance companies.”

“If a person has been seriously injured in an accident or lost a loved one in a car wreck or similar incident, they have a right to proper compensation for their losses,” he said. “An experienced personal injury lawyer will work hard to ensure they get the full amount of compensation they deserve.”

Did you know that March is Brain Injury Awareness Month? We discuss brain injuries every now and then on this personal injury blog. Such an injury can range from mild to catastrophic, but no matter what the extent, a brain injury should never go unnoticed.

In the past, communities just didn't know enough about the effects of injuries that seem as common and insignificant as concussions. But in recent years, high-profile athletes' stories have highlighted how important it is to address safety in high-impact sports and impose stricter safety rules to protect athletes of all ages, from adult to child.

According to the Centers for Disease Control and Prevention, about 3.8 million concussions occur in the country annually. Again, those injuries affect people of all ages, and it's the children who sustain such brain injuries that the public needs to hurry to protect.

Because kids' brains are still developing, they are extremely vulnerable to damage. Compared to an injured adult, a child or teen's concussion won't heal as quickly. It is crucial that brain injuries are diagnosed among the young and that the responsible adults, including coaches and parents, don't let injured kids return to sports or other impact activities before a doctor confirms that they are fully healed.

March is almost over. Summer vacation and summer activities are just around the corner, so it would be foolish for brain injury awareness to end just because March does. Be educated on the dangers of concussions and don't hesitate to pull your child out of a game and into a doctor's office if you suspect that he or she's been injured.

In the five years to 2017, industry revenue is forecast to grow 2.0% annually to $29.5 billion. During that time, industry operators will benefit from an increase of revenue streams generated by structured settlements, which have become more popular during the past five years. Structured settlements are an arrangement in which damages are paid out over a period of time rather than all at once. During the recession, structured settlements became increasingly popular because many defendants were unable to pay damages in one lump sum. As such, industry operators will generate a great proportion of revenue from past settlements in the years going forward. While structured settlements will help boost industry profit margins over the next five years, industry profit growth will be restrained by increasing price competition. An influx of law students, who pursued degrees rather than enter the job market, will lead to higher competition and a boost in the number of small firms. The industry will remain highly fragmented, with the average firm having only three employees.
