"He was not enthusiastic about going into another distribution," said the lawyer, John Henry Browne. "He was told he was not to go back, and then he was told that he went."
Browne said he was asked to represent the soldier, a 38-year-old of joint Base Lewis-McChord staff sergeant in the State of Washington.
The soldier from the Seattle area and asked to be represented by Browne, when he was taken into custody, said the lawyer. Browne said he met with the family of staff sergeant, and unless the joint Base Lewis-McChord soldier returned to in the coming days, he will travel to meet the soldier, where he is in custody.
Browne declined to release the soldier name, which the army has withheld.
"Everyone is concerned about the safety of his family, and I'm a tribute to that," said Browne.
The soldier is suspected of going on a shooting rampage in villages near his base in southern Afghanistan early Sunday, killing nine children and seven other civilians and then burn some of their organs. The shooting, which followed a controversial Qur'an burning incident involving American soldiers, has furiously-Afghan officials.
The suspect had flown out of Afghanistan on Wednesday evening at what officials described as a pretrial detention facility in Kuwait. Speaking on condition of anonymity officials have described him as a father of two who has been in the military for 11 years. He has served in three rounds began his first broadcast to Iraq and Afghanistan in December.
Browne said he has a limited amount of information about his potential client. He described the highly decorated soldier and said that he had twice wounded during deployments to Iraq, once a concussive head injury and serious injury once a leg.
Some reports have indicated that alcohol may have been a factor in the shooting. Browne said that insofar as the soldier's family knew, he doesn't possess a beverage problem.
Colton Harris-Moore, who represented Browne recently received international attention as the "Barefoot Bandit" for stealing aircraft, boats and cars during a two-year run from the law. Browne said he has treated only three or four military affairs. The soldier also will have at least one military lawyer.
A congressional source, speaking on condition of anonymity due to the sensitivity of the information, told The Associated Press that the suspect with the 2nd Battalion, 3rd infantry regiment, 3rd Stryker Brigade Combat Team was before stability operation is assigned to a village near the villages where the attack took place.
